These Terms of Service (“Terms”) govern your access to and use of the Flexbound mobile application, flexbound.app, and related services (the “Service”). By creating an account, downloading the app, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
This document is a practical boilerplate for App Store submission. It is not personalized legal advice. Have counsel review before relying on it as your final terms.
1. The Service
Flexbound is a notebook-style fitness and nutrition logbook. You can write training and food notes, review structured workout data, estimate meals, generate weekly reviews and workout plans, and view methodology-backed coaching notes.
The Service may operate in a local-first mode on your device and, when configured, may use cloud accounts, sync, AI-assisted writing, nutrition data providers, and subscription entitlements.
2. Eligibility
You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under 18, you may use the Service only with a parent or guardian’s permission. You are responsible for complying with local laws.
3. Accounts
Some features (including purchases and remote sync) may require an account. You agree to provide accurate information, keep credentials secure, and notify us of unauthorized use. You are responsible for activity under your account.
You may delete your account in the app when signed in (Settings → Delete account and remote data). Deletion removes remote user-owned data associated with your account and clears local app data on that device, subject to backups, logs retained for security/legal reasons, and App Store / payment records we do not control.
4. Not medical advice
Flexbound is not a medical device and does not provide medical advice, diagnosis, or treatment.
Workout plans, progression notes, pain or fatigue signals, nutrition estimates, calorie/macro targets, and AI-generated text are informational starting points only. They can be incomplete or wrong. You are solely responsible for deciding whether any suggestion is safe and appropriate for you.
Stop or modify activity if you experience pain, dizziness, injury, or other concerning symptoms. Consult a qualified clinician, registered dietitian, or other professional for medical, dietary, or training concerns, especially if you have a health condition, are pregnant, or are recovering from injury.
5. Your content
You retain ownership of the content you enter (journal text, notes, corrections, photos if later supported, and similar “User Content”).
You grant us a limited license to host, process, transmit, and display User Content solely to operate and improve the Service (for example parsing, estimates, sync, and support). We do not claim ownership of your raw journal text.
You represent that you have the rights to submit User Content and that it does not violate law or third-party rights.
Raw journal text is treated as your source of truth inside the app. Parsing and AI create separate structured records; they should not silently rewrite your original notes.
6. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, or abusive purposes
- Attempt to reverse engineer, scrape, overload, or disrupt the Service
- Bypass freemium limits, paywalls, or security controls
- Misrepresent AI or estimate outputs as professional medical or dietary advice
- Upload malware or content you do not have rights to use
We may suspend or terminate access for violations or to protect the Service and other users.
7. Subscriptions and freemium
Flexbound may offer a Free plan with usage limits and a paid Flexbound Pro subscription.
- Prices, billing period, and localized amounts are shown in the app at purchase time (via Apple / Google and RevenueCat).
- Payment is charged to your Apple ID or Google Play account.
- Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period.
- Manage or cancel in your device account settings (for example Settings → Apple ID → Subscriptions on iOS).
- Refunds are handled by the applicable app store under its policies.
- Restoring purchases re-links an existing subscription to your signed-in account when available.
Free-plan limits and Pro features are described in-app and may change. Material changes to paid entitlements will be communicated through the app or store listing when required.
8. AI, estimates, and third-party data
The Service may use deterministic calculators and third-party services (for example AI writing models, USDA FoodData Central, Open Food Facts, and research/citation tools) via our backend. Outputs may include confidence labels and source traces. Low-confidence estimates must not be treated as exact.
We do not guarantee uninterrupted availability, accuracy of nutrition databases, or fitness of outputs for any particular purpose.
9. Intellectual property
The Service, including software, design, branding, methodology library presentation, and documentation, is owned by us or our licensors. These Terms do not grant you rights to our trademarks or code except as needed to use the Service.
10. Privacy
Our Privacy Policy explains how we collect and use information. By using the Service, you also acknowledge that policy.
11. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT ESTIMATES OR AI OUTPUT WILL BE ACCURATE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
Some jurisdictions do not allow certain limitations; in those cases, the above limits apply only to the extent permitted.
13. Indemnity
You agree to indemnify and hold us harmless from claims arising out of your User Content, your misuse of the Service, or your violation of these Terms, to the extent permitted by law.
14. Changes
We may update these Terms. The “Last updated” date will change when we do. Continued use after changes become effective constitutes acceptance, except where applicable law requires additional consent.
15. Termination
You may stop using the Service at any time and may delete your account as described above. We may stop providing the Service or terminate access for cause or if we discontinue the product. Provisions that by nature should survive (including ownership, disclaimers, and liability limits) will survive termination.
16. Governing law
These Terms are governed by the laws of the State of California, USA, excluding conflict-of-law rules, unless mandatory consumer protections in your country of residence require otherwise. Courts in California will have jurisdiction, subject to those mandatory protections.
